Scale It Mastermind – Terms & Conditions

These terms and conditions apply to the Scale It Mastermind provided by The VA Foundry

Services

The VA Foundry Limited offers certain online courses and membership content relating to starting and scaling a virtual assistant business and related subjects. The Mastermind description is intended to indicate only the general nature of the mastermind and does not guarantee content. The VA Foundry reserves the right to amend the Mastermind and alter details at its discretion. The Mastermind may be withdrawn at any time, subject to thirty days prior notice.

Payment / Registration

The Scale It Mastermind has a minimum 12 month membership policy. You may choose between a monthly subscription payment of $297 NZD per month for at least 12 months or 1 annual payment of $2970 NZD. If you elect to pay for the annual membership to the Mastermind in full, you can pay in one payment of $2970 NZD. If you select the monthly payment option, you must pay the initial payment today and then your selected payment method will be automatically charged the following 11 payments on a monthly basis, for a total payment of $3564 NZD. If you opt for monthly payments, you will remain responsible for those payments unless you obtain a refund according to The VA Foundry’s Refund Policy set forth below. You may not cancel or avoid these payments except through the Refund Policy. In the event that any payment is not made, The VA Foundry shall immediately suspend your access to the Mastermind.

Once you have been in the Mastermind for the 12 month minimum your membership will continue until you choose to cancel. If you opted for the monthly payment option, these payments will continue after your 12 month anniversary. If you opted for the annual payment, your annual payments will continue on each 12 month anniversary date until you choose to cancel. Once you cancel you'll then have access up until your payment anniversary date.

Courses will be billed in New Zealand Dollars (NZD), Australian Dollars (AUD) and US Dollars (USD). Accepted payment methods are PayPal, MasterCard or Visa.

You agree to provide accurate and complete registration information. Submission of your registration, alongside full (or first) payment of the Fee constitute your acceptance of these Terms and Conditions.

Cancellations and Refunds

You may cancel your membership up to 7 days after you join. Following the 7 days, a refund cannot be offered.

Please note: If you opted for a monthly payment and do not request to cancel your registration within 7 days of joining, you are required by law to complete the remaining payments of your payment plan.

Once you have completed your 12 month minimum membership in the Mastermind, you can cancel anytime. Once you cancel you'll then have access to the Membership up until your payment anniversary date.

The VA Foundry reserves the right to cancel the Mastermind by giving you notice in writing (including by email) at any time. The VA Foundry will refund your last monthly payment or the pro rata of the annual payment upon notice. The VA Foundry’s liability when it cancels an online Mastermind will be limited to a refund of the Fee. 

All session dates are subject to change, however notice of such change will be given and refunds will not be issued for any rescheduled session.

Copyright

All materials – including but not limited to text, photographs, video, audio, images, templates, checklists, graphics and any other content – appearing via the Course and/or on the Website are protected by copyrights and/or other proprietary rights belonging to The VA Foundry and/or other third parties. You agree to abide by all applicable laws regarding copyrights, trademarks, publicity rights and privacy rights in NZ, AUS, the US, UK and any other jurisdiction from which you are accessing the Website.

You may not copy, reproduce, duplicate, distribute, disseminate, publish, post, display, perform, modify, create derivative works from, upload to, transmit, or in any way exploit any content from the Mastermind and/or on the Website. You may not sell or offer for sale any of the content, or allow third parties to access it, or use such content to construct any kind of database. You may use the content from the Course and/or on the Website only for personal, non-commercial use.

You agree to maintain the security of any user name and password required for accessing the Course. You will notify us promptly if you become aware of any unauthorised use of your username and/or password. Only you may access the course using your login details.

Data protection

By registering with The VA Foundry and by paying the fees, you agree to The VA Foundry collecting and using your personal data. This will be done in accordance with The VA Foundry’s privacy policy. Unless you request otherwise, we reserve the right to share your name and results on social media at any time.

Technology requirements

The Mastermind is facilitated through our online learning management system Kajabi, on Zoom and inside a Facebook Group. It is your responsibility to ensure that you have the proper hardware and software requirements, along with access to Wi-Fi, to be able to participate in the Mastermind. The VA Foundry is not be responsible for any errors or failures in relation to your ability to access the Mastermind, the Website or any related materials, including where such errors or failures are caused by: (i) a loss of connection on The VA Foundry’s or your end; (ii) a breakdown or problems with the online software and/or (iii) a breakdown or problems with your internet connection, computer or system.

Limitation of liability

Except in case of intentional misconduct or gross negligence, The VA Foundry accepts no liability for any damages caused in connection with the services under this agreement. This includes but is not limited to damages in the form of data loss, failure to operate, lost revenue or missed profits. It is your responsibility to seek the appropriate professional legal and financial advice for your business.

Term

The service is provided for the lifetime of the Mastermind, as decided by The VA Foundry. Once you join the Mastermind you only have access to the Mastermind content for as long as you are a paying member.

Law and venue

Any disputes in connection with this agreement are governed by New Zealand law and must be brought before the courts of New Zealand.
